Right of Immigration and Citizenship

Right of Immigration

The migratory phenomena taking place in Europe are not simple movements of individuals or groups. A resettlement of the world’s population is underway, driven by economic, demographic and political factors destined to persist in the medium term. Unequal international economic development, growing gap between areas of well-being and areas of misery, the demographic boom of poor countries and the birth rate of the most industrialized ones, wars and ethnic and religious conflicts are the driving force behind this phenomenon. Phenomena of this magnitude do not stem by fortifying borders, but govern themselves. The advent of a multi-ethnic society is not a choice, but the inevitable future of Europe. The problem, the gamble of individual nation states and of Europe as a whole, concerns the methods of implementation of this society.

Right of Citizenship

Citizenship is the legal and social condition of those who belong to a State, from which the recognition of civil, social, economic and political rights and as many duties derive.

The reform: ius culturae and ius soli temperato. To date, since the principle of ius soli is not valid in our country, those born of foreign parents can apply for citizenship if they resided in Italy continuously and regularly up to the age of majority, submitting the application by their 19th birthday. On the contrary, as you will remember of the fastest man in the world, the Italian-American Marcell Jacobs, born in the United States but to an Italian mother and therefore, by ius sanguinis, an Italian citizen by right.
