Civil Right
It includes the subject of contracts, obligations, real rights, persons and family, succession due to death, civil liability.
The interpretative activity of the Court in the context of the protection of fundamental rights – characterized above all, in the last twenty years, by an expansion of the so-called social rights – highlighted important profiles with reference to people with disabilities.
Court and Judgments
On several occasions the Court has dealt with the issue of disabilities, and in particular the need to allow socialization and the conscious participation of disabled people – interpreting Article 38 of the Constitution in the light of the personalist principle, pursuant to art. 2, and the principle of substantial equality, pursuant to art. 3, paragraph 2 -, with the effect of a material extension of the protection of related rights to all areas of social life.
Sentence no. 258 of 2017, with which the Court declared illegitimate – for violation of articles 2 and 3, first and second paragraphs, of the Constitution – art. 10 of the law n. 91/1992, in the part in which it does not provide that, for the purposes of the transcription of the decree granting Italian citizenship, a person unable to fulfill this requirement due to a serious and ascertained condition of disability is exempted from the oath of loyalty to the Republic.
